To join the class action, you must have lived in the Redland local government area and been subject to a special levy (established in 2011) in relation to canal/waterways maintenance including marina special charges in the period from 2011 to 2017.
Shine Lawyers, one of Australia’s largest litigation law firms, has filed proceedings on behalf of ratepayers against Redland City Council (RCC).
RCC recently advised that the special levy that it imposed on ratepayers in Redland did not meet all necessary requirements and was potentially contrary to the requirements of the Local Government Act. While RCC has refunded part of the monies raised pursuant to the special levy, Shine considers that the RCC is liable to ratepayers for the remaining amount.
Proceedings were filed in October 2018. RCC is yet to file a defence.
